Welcome to Remy & Co. These Terms of Service ("Terms") govern your use of our website and the purchase of products from Remy & Co. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

Throughout these Terms, "Remy & Co.", "we", "our", and "us" refer to Remy & Co. "You" and "your" refer to the customer or website user.

1. Eligibility

By placing an order through our website, you confirm that you are at least 18 years of age or have permission from a parent or legal guardian to make the purchase.

2. Products

We take great care to accurately display our products, colours and descriptions. However, colours may vary slightly depending on your device or monitor settings.

All garments are subject to availability. As we produce limited quantities, some products may sell out without notice.

We reserve the right to discontinue, modify or update products at any time without notice.

3. Pricing

All prices displayed on our website are shown in the currency selected or presented to you based on your location. Customers shopping from New Zealand will generally see prices in New Zealand Dollars (NZD), while customers shopping from Australia will generally see prices in Australian Dollars (AUD).

Prices are subject to change without notice. We reserve the right to correct pricing errors or inaccuracies at any time.

Remy & Co. is not currently registered for Australian GST. Any duties, taxes, customs charges or import fees that may apply to international orders are the responsibility of the customer.

If your payment provider processes your payment in a different currency, exchange rates and foreign transaction fees may apply. These charges are determined by your financial institution and are not the responsibility of Remy & Co.

4. Orders

Submitting an order does not guarantee acceptance.

We reserve the right to refuse or cancel any order where we reasonably suspect fraud, unauthorised payment activity, pricing errors or stock discrepancies.

If payment has already been processed for an order that cannot be fulfilled, a full refund will be issued for the affected item(s).

Once an order has been placed, we begin preparing it for dispatch as quickly as possible. While we will do our best to accommodate requests, we cannot guarantee that orders can be amended or cancelled after they have been placed.

5. Payment

Payment must be received in full before your order is dispatched.

We accept the payment methods displayed at checkout, including major credit and debit cards, Shop Pay, Apple Pay, Google Pay and Afterpay where available.

If a payment is declined or cannot be authorised, your order will not be processed.

6. Shipping & Delivery

Shipping costs and estimated delivery timeframes are displayed during checkout and outlined in our Shipping Policy.

While we aim to dispatch orders promptly, delivery timeframes are estimates only and are subject to courier delays outside our control.

All parcels are shipped with Authority to Leave unless otherwise stated.

Risk in the goods passes to you once your order has been delivered to the delivery address provided at checkout. This does not affect any rights you may have under applicable consumer protection laws.

7. Returns & Refunds

Our Return & Refund Policy forms part of these Terms of Service.

By placing an order, you acknowledge and agree to our Return & Refund Policy.

8. Promotions & Discount Codes

From time to time, Remy & Co. may offer promotional discounts or discount codes.

Unless otherwise stated:

  • Only one discount code may be used per order.
  • Discount codes cannot be applied retrospectively.
  • Discount codes have no cash value.
  • Discount codes may exclude sale items or other promotions.
  • We reserve the right to modify, suspend or withdraw promotions at any time without notice.

9. Gift Cards

Where gift cards are offered:

  • Gift cards are non-refundable and cannot be exchanged for cash.
  • Lost or stolen gift cards cannot be replaced.
  • Gift cards may only be redeemed through our website.
  • Gift cards are subject to any additional terms displayed at the time of purchase.

10. Intellectual Property

All content on this website, including photographs, graphics, logos, branding, product names, product descriptions, website design and other intellectual property, is owned by Remy & Co. or licensed for our use.

No content may be copied, reproduced, distributed, published or used without our prior written consent.

11. Website Availability

While we strive to keep our website available at all times, we do not guarantee uninterrupted access.

We may suspend, update, modify or remove any part of the website at any time without notice.

12. Limitation of Liability

To the maximum extent permitted by law, Remy & Co. shall not be liable for any indirect, incidental, consequential or special loss or damage arising from your use of our website or products.

Nothing in these Terms excludes or limits any rights that cannot be excluded under New Zealand law.

13. Consumer Rights

Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable New Zealand consumer protection legislation.

Where products are supplied to consumers in Australia, nothing in these Terms limits any mandatory rights available under applicable Australian Consumer Law.

14. Privacy

Your use of our website is also governed by our Privacy Policy.

By using our website, you consent to the collection, storage and use of your personal information in accordance with our Privacy Policy.

15. Force Majeure

Remy & Co. shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, industrial disputes, supplier shortages, transport disruptions, governmental action, internet outages or other unforeseen events.

16. Governing Law

These Terms of Service are governed by the laws of New Zealand.

Any disputes arising from these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of New Zealand.
